Terms of Service

The agreement between you and Katalogiq when you use the service.

The service

Katalogiq (katalogiq.com) is an online service operated by NorthDock B.V., registered with the Dutch Chamber of Commerce under number 42005535, with registered office at Eurenderstraat 13, 6467 CS Kerkrade, the Netherlands. Katalogiq quality-checks uploaded product photos, extracts product attributes and generates image variants using AI models.

By creating a workspace or using the service you agree to these terms. If you use Katalogiq on behalf of a company, you confirm that you are authorised to bind that company.

Accounts

You must provide accurate account information and keep your credentials confidential. The workspace master account is responsible for the actions of its sub-users. Notify us immediately at hello@katalogiq.com if you suspect unauthorised use of your account.

Acceptable use

You agree not to:

  • Upload content that is unlawful, infringing, or that you do not hold the rights to use.
  • Generate images that are misleading in ways prohibited by law, or that violate the rights of others.
  • Probe, disrupt or overload the service, or attempt to access other customers' data.
  • Resell or offer the service to third parties as your own without our written consent.
  • Circumvent quotas, rate limits or billing.

Quotas and fair use

Each plan includes a monthly upload quota; additional uploads and generated images are billed at the per-unit prices on the pricing page. To keep the platform stable for everyone we may apply technical limits, such as rate limits and hard caps set well above normal use. We will contact you before restricting an account that structurally exceeds fair use.

Your content and intellectual property

You retain all rights to the photos you upload. You own the images Katalogiq generates from your uploads and may use them commercially on any channel. You grant us a limited licence to store and process your content solely to provide the service. We do not use your content to train AI models and we do not resell it. The Katalogiq software, brand and website remain our property.

Payment, renewal and cancellation

Plans are billed monthly or annually in advance through our payment provider Mollie; usage charges (extra uploads and generated images) are invoiced in arrears. Invoices are issued automatically and sent by email. All prices exclude VAT.

Subscriptions renew automatically. You can cancel at any time from the app; cancellation takes effect at the end of the current billing cycle (month or year), and amounts already paid for that cycle are not refunded. We may change prices with at least 30 days' notice; changes apply from your next renewal.

Availability

We aim to keep Katalogiq available at all times, but the service is provided "as is", without an uptime guarantee (unless you have a separate SLA on the Scale plan or an enterprise agreement). We may perform maintenance, and AI generation depends on third-party model providers whose availability and output quality can vary. You review generated images before using them.

Liability

To the extent permitted by Dutch law, our total liability for any claim arising out of or related to the service is limited to the amounts you paid us in the 12 months preceding the event, and we are not liable for indirect damages such as lost profits, lost data or reputational harm. Nothing in these terms limits liability for intent or deliberate recklessness.

Suspension and termination

We may suspend or terminate accounts that materially breach these terms or endanger the platform — where reasonably possible, after a warning. After termination of your account you can export your data (images and Excel exports) for 30 days, after which we delete it, except for data we are legally required to retain.

Changes

We may change the service and these terms. Material changes to the terms will be announced at least 30 days in advance by email or in the app. If you do not agree with a change, you can cancel before it takes effect.

Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise. Questions about these terms? Email hello@katalogiq.com.
